Eligibility Guidelines for COBRA

There are several cases when a continuing employee's family members might become eligible for benefits under the Consolidated Omnibus Budget Reconciliation Act (COBRA):

Qualifying Events for Spouses:

  • An employee’s work hours are reduced below the coverage point.
  • An employee becomes eligible for Medicare.
  • An employee gets divorced or legally separated.

Qualifying Events for Dependent Children:

  • A child is no longer considered “dependent” under the plan.
  • An employee’s work hours are reduced below the coverage point.
  • An employee becomes eligible for Medicare.
  • An employee becomes divorced or legally separated.
